BY USING OR ACCESSING THE SITE AND/OR THE SERVICES, YOU ARE ACCEPTING THE PRACTICES DESCRIBED IN THIS PRIVACY POLICY. COLLECTION AND USE OF INFORMATION

All information transmitted, printed or otherwise submitted to GunAssociation.org via this website shall be deemed to be the property of American Gun Association and American Gun Association shall be free to use such information for any lawful purpose as detailed herein.

We may collect and use information about you in a variety of ways. Examples of the types of data we collect and use include:

Financial Information. We do not collect and store your financial information such as your payment method (valid credit card number, type, expiration date or other financial information). If you transact business with us, your financial information is collected by our reputable, PCI Compliant merchant processor who uses secure SSL and tokenization of the data to protect your financial data.

Derivative Data.  Like most website operators, we gather from Users of the Site information of the sort that web browsers, depending on their settings, may make available or that our servers automatically recognize when you access the Site or the Services. That information includes your Internet Protocol (IP) address, operating system and browser type, and the locations of the websites you view right before arriving at, while navigating and immediately after leaving the Site; the dates, times, duration and frequency of your interactions with our Services, search terms, the media files you download, interact with or share, favorites you select, and your navigation path through our Services; listening data, including information about your interactions with our podcasts and other media files, such as time and date stamps for when a file is downloaded and when playback of a particular segment or sponsorship message starts, stops, is skipped or paused. Such information is not personally identifiable, but it still may be possible for us to determine from an IP address your Internet service provider and the geographic location of your point of connectivity, as well as other statistical usage data. We may analyze such information to help us better understand how the Site is being used. By identifying patterns and trends in usage, we are able to better design the Site to improve your experiences, both in terms of content and ease of use. From time to time, we may also release this information in the aggregate, such as by publishing a report on trends in the usage of the Site.

Personal Information.  At the time you register with the Site, we may collect “Personal Information” about you, which is information that, without more, can be directly associated with a specific person. Personal Information may include your name, residential or business address, email address and telephone number, and information knowingly provided by you through on-line forms, registration forms, and surveys. If you sign in to the Services from a social networking service (“SNS”), we receive your email address and certain profile information from such SNS in accordance with its privacy policy and your SNS account privacy settings. We also may request information about your interests, activities, gender, age, date of birth, username, hometown and other demographic or relevant information as determined by us from time to time. You are under no obligation to provide us with Personal Information of any kind, with the caveat that your refusal to do so may prevent you from using certain features of the Site or the Services.

Email Communications.  We may occasionally use your name and email address to send you notifications regarding new services offered by the Site that we think you may find valuable. We may also send you service-related announcements from time to time. Generally, you may opt out of such emails at the time of registration or by following the unsubscribe link in the email communications, though we reserve the right to continue to send you notices about your account and Services you have requested.

General Use.  We use the Personal Information we maintain about you, and other information we obtain from your current and past activities on the Site to: (1) deliver the products and services that you have requested; (2) manage your account and provide you with customer support; (3) communicate with you by email, postal mail, telephone and/or mobile devices about products or services that may be of interest to you either from us, our Associates or other third parties and affiliates; (4) develop and display content and advertising tailored to your interests on the Site and other sites; (5) resolve disputes and troubleshoot problems; (6) measure consumer interest in the Services; (7) inform you of updates; (8) customize your experience; (9) detect and protect us against error, fraud and other criminal activity; (10) enforce our Terms of Use; and (11) do as otherwise described to you at the time of collection. At times, we may look across multiple Users to identify problems. In particular, we may examine your Personal Information to identify Users using multiple User IDs or aliases. Contests, Giveaways and Surveys.  From time to time, we may offer you the opportunity to participate in contests, giveaways and other promotions. Any information submitted in connection with such activities will be treated in accordance with this Privacy Policy. From time to time, we may also ask you to participate in surveys designed to help us improve the Site. Any Personal Information provided to us in connection with any survey will be used only in relation to that survey, and will be disclosed to third parties not bound by this Privacy Policy only in aggregated form

Online Postings.  Certain Personal Information collected from you is disclosed as a matter of course as a result of your use of the Site. We may provide publicly-viewable areas on the Site where you can post reviews and other information relating to your activities on the Site. Such postings are governed by our Terms of Use. Whenever you voluntarily disclose Personal Information in publicly-viewable areas of the Site, that information will be publicly available and can be collected and used by others. For example, if you post your email address, you may receive unsolicited messages. In addition, such postings may appear on other websites or when searches are executed on the subject of your posting. We cannot control who reads your postings or what other Users may do with the information you voluntarily post, so we encourage you to exercise discretion and caution with respect to your Personal Information. Business Partners.  When you make purchases or engage in promotions offered through the Site or the Services that use third parties to deliver such product or Service, we may share your Personal Information with our business partners to offer you those products, services or promotions. When you elect to make a purchase or engage in promotions offered through the Site or the Services, you authorize us to provide your email address and other Personal Information to our business partners.

Associates.  We may share some or all of your Personal Information with our Associates, in which case we will require those Associates to honor this Privacy Policy. Associates include any subsidiaries, joint venture partners or other companies that we control or that are under common control with us. Such intercompany transfers may be to and from the United States and any other country in which we or our agents maintain facilities for the purposes identified in this Privacy Policy, as well as for storage, processing or other business use as permitted under this Privacy Policy.

Third Party Service Providers.  We may share your Personal Information, which may include your name and contact information (including email address) with our authorized service providers that perform certain services for or on our behalf. These services may include fulfilling orders, providing customer service and marketing assistance, performing business and sales analysis, supporting the Site’s functionality and supporting contests, sweepstakes, surveys and other features offered through the Site. We may also share your name, contact information and credit card information with our authorized service providers who process credit card payments. These service providers may have access to your Personal Information and/or financial information as needed to perform their functions, but are not permitted to share or use such information for any other purpose.

Business Transfers and Bankruptcy.  We reserve the right to transfer all of your Personal Information in our possession to a successor organization in the event of a merger, acquisition, bankruptcy or other sale of all or a portion of our assets. You acknowledge that any such transfers may occur, and that the successor organization or other transferee may decline to honor commitments made in this Privacy Policy.

TRACKING TECHNOLOGIES

Cookies. Similar to other commercial websites, our website utilizes a standard technology called “cookies” to: (1) keep track of the Services you have used; (2) record registration information regarding your login name and password; (3) record your User preferences; (4) keep you logged into the Site; and (5) facilitate purchase procedures. We also use cookies to track the pages that you visit during each session, both to help us improve your experience and to help us understand how the Site is being used. We analyze and disclose in aggregated form information gathered using cookies, so as to help us, our partners and others better understand how the Site and the Services are being used. Web Beacons.  We may use web beacons on the Site and in emails to count Users who have visited particular pages and viewed emails, and to deliver co-branded services. Analytics. We may also partner with selected third party vendors, such as Google Analytics, to allow tracking technologies and remarketing services on the Site through the use of first party cookies (such as the Google Analytics cookie) and third party cookies (such as the DoubleClick cookie), including Google Analytics for Display Advertising and Google AdWords. If you do not want any information to be collected and used by Google Analytics, you can install a Google Analytics opt-out plugin in your web browser, update your preferences in the Google Ads Settings page or use the Network Advertising Initiative opt-out tool.

LINKS TO THIRD PARTY WEBSITES

The Site and the Services may contain links to third party websites and applications of interest, including advertisements and external services. However, once you have used these links to leave the Site, you should note that we neither own nor have any control over those third party websites or applications. Thus, this Privacy Policy does not apply to information provided to or gathered by the third parties that operate them. SECURITY

We use reasonable administrative, technical and physical measures to protect your Personal Information from loss, theft, alteration or misuse.  However, please be advised that even the best security measures cannot fully eliminate all risks. Any data disclosed online is vulnerable to interception and misuse by unauthorized third parties. We cannot guarantee that only authorized persons will view your Personal Information. We are not responsible for third party circumvention of any privacy settings or security measures.

CHANGING OR TERMINATING YOUR ACCOUNT

You may at any time review or change the information in your account or terminate your account by going to your account settings or by contacting us using the contact information provided below. Upon Your request, we will deactivate or delete your account and Personal Information from our active databases. Such Personal Information will be deactivated or deleted as soon as practicable based on your account activity and in accordance with our deactivation policy and applicable law. We will retain in our files some of your Personal Information to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and comply with legal requirements as is permitted by law. Therefore, you should not expect that all of your Personal Information will be completely removed from our databases in response to your requests unless required by law. Additionally, we keep a history of changed information to investigate suspected fraud with your account.

PRIVACY POLICY CHANGES

We reserve the right to make changes or modifications to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Version Date” of this Privacy Policy. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on the Site, and you waive the right to receive specific notice of each such change or modification. We understand consumers’ concerns over the use of their personal information. We hope this information will relieve any concerns your company may have regarding our email policies. American Gun Association and its affiliated sites use only an “opt-in or opt out” method of obtaining customer information, and it is not our policy or desire to send unsolicited email. We obtain email addresses and personal information from third parties that follow the same set of policies. From time to time, we will enter into an arrangement with a third party website to allow individuals to opt into our marketing program on those third party websites. In each case the third party websites have represented and warranted to us, among other things,

  • that the data was collected voluntarily from individuals on website registrations and co-registrations,
  • that the sellers have a right, under any applicable privacy statements, to transfer the data to us, and
  • that American Gun Association has the right to send marketing offers to the individuals.

POLICY FOR CHILDREN

The Children’s Online Privacy Protection Act protects the online privacy of children under 13 years of age. The Site and the Services are not directed to children, and we do not knowingly collect or maintain Personal Information from anyone under the age of 13. If we learn that Personal Information has been collected from a User under 13 years of age, we will take the appropriate steps to cause this Personal Information to be deleted from our records. If you are the parent or legal guardian of a child under 13 years of age who has registered with the Site or has otherwise transferred Personal Information to the Site, please contact us using the contact information provided below to have your child’s account terminated and Personal Information deleted. If you are under 18 years of age, reside in California and have a registered account on the Site, you have the right to request removal of unwanted Personal Information that you publicly disclose on the Site. To request removal of such Personal Information, contact us using the contact information provided below and include a statement that you reside in California. While we will make sure the Personal Information is not publicly displayed on the Site, please be aware that the data may not be completely or comprehensively removed from our systems.

CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our Users who are California residents to request and obtain from us, once a year and free of charge, information about the Personal Information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of Personal Information that was shared, and the names and addresses of all third parties with which we shared Personal Information in the immediately preceding calendar year.  DO-NOT-TRACK FEATURE

Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. Because there is not yet a common understanding of how to interpret the DNT signal, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.
